SAN JOSE, Calif.(KMUV-TV) -- UPDATE April 20, 2022 10 am The Santa Clara District Attorney's office announced the man suspected of starting the Home Depot fire in San Jose.Dyllin Jaycruz Gogue, 27, of San Jose, was arrested on April 15 and faces multiple charges.According to the District Attorney's office, the suspect set the fire in a hallway when he was trying to steal tools from the hardware store."I am grateful to all of our law enforcement partners who have quickly brought this individual to justice," said District Attorney Jeff Rosen."And I'm thankful that this was not a mass murder case. This fire - set during business hours - could easily have left bodies in the rubble. It was terribly reckless behavior, and we will pursue it to the fullest extent of the law." .Among the charges against him are aggravated arson, seven counts of grand theft and three of petty theft.The prosecutor's office said the fire started at 5:30 pm and Gogue was stopped by a store employee as he was leaving with a cart of stolen tools.The prosecutor's office said he stole items from a Bass Pro store before, fled in someone's car after lighting the Home Depot on fire and when he robbed a nearby Macy's."ATF's National Response Team, or NRT, arrived at the scene of The Home Depot fire during the preliminary stages of this investigation. We brought our fire scene analysis experience to the San Jose Fire Department to determine if the fire was arson, accidental, or undetermined ATF approaches each fire scene without preconception, allowing the evidence to guide us to a conclusion After reviewing all the evidence, ATF and our partners classified this fire as arsonist, meaning it was intentionally set and is considered an act of arson.
